THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.13007 of 2025 ORDER:
This Criminal Petition is filed seeking the Court to enlarge the petitioner, on bail, who is arrayed as accused in Crime No.272 of 2025 of Amangal Police Station, Cyberabad Commissionerate.

The brief facts of the case are that on 27.09.2025, the complainant, who is the mother of the victim girl, lodged a complaint stating that her younger daughter, studying Intermediate 2nd year in Government College, Amangal, went missing from their house around 3:30 p.m. along with her mother's mobile phone. Despite searching in all possible places, she could not be found, and suspicion was raised against one Santhosh Kumar, a villager.

Heard Smt. Mogili Anaveni, learned counsel appearing on behalf of the petitioner as well as Sri D. Arun Kumar, learned Additional Public Prosecutor appearing on behalf of the respondent - State.

Learned counsel for the petitioner submitted that the petitioner was innocent and falsely implicated in the case without any proper evidence and that the petitioner and the victim were in love for the past three years and that the victim had voluntarily gone with him without any force or coercion, hence the allegation of kidnapping or rape did not arise. He further submitted that an earlier FIR had already been registered on the same issue and that the police mechanically registered a second case without proper enquiry. The counsel argued that the investigation was completed, the petitioner had been in judicial custody since 30.09.2025. Therefore, he prayed the Court to grant bail to the petitioner by allowing this criminal petition.

On the other hand, learned Additional Public Prosecutor opposed the bail stating that the allegations against the petitioner are heinous in nature. At this stage, granting of bail to the petitioner does not arise. Therefore, he prayed the Court to dismiss the criminal petition.

In the light of the submissions made by both the learned counsel and upon perusal of the material available on record, it appears that the petitioner has been in jail since
30.09.2025. As seen from the record, there are no other criminal cases pending against the petitioner, and the material part of the investigation has been completed and L.Ws.1 to 15 were examined. Considering the facts and circumstances of the case, as well as the period of incarceration of the petitioner, this Court deems it fit to grant bail to the petitioner subject to the following conditions: i.
The petitioner shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties for a like sum each to the satisfaction of the learned Judicial Magistrate of First Class, Amangal.
ii.
The petitioner shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) week or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.
iii.
The petitioner shall abide by the conditions stipulated in Section 437(3) of Cr.P.C.(presently, Section 480(3) of the BNSS).

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
