HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 40112 of 2016 ORDER:
Heard the learned counsel for the petitioner and learned Government Pleader for Revenue and, with their consent, the writ petition is disposed of at the admission stage. The petitioner seeks a direction to the fourth respondent not to make any construction in the access road existing on the northern side of plot No.10 (part) in Sy.No.98, Burhanpuram, Khammam District.
Learned Counsel for the petitioner submits that the fourth respondent is raising construction in the access road due to which, it is obstructing the petitioner's right of access to the road. Sri P. Srinivas, learned counsel for the fourth respondent, submits that the subject land has been allotted to the Irrigation Department.
Since there is a dispute between two private individuals with regard to easementary rights over the subject land, where the fourth respondent is alleged to have been making constructions, the petitioner is at liberty to approach the Civil Court and avail the remedy.
With the above direction, the Writ Petition is disposed of. There shall be no order as to costs. Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed. _____________________ C. PRAVEEN KUMAR,J Dt: 21.11.2016 usd
