Heard the learned counsel appearing for the petitioner and the learned Government Pleader for Forests.
Sri G.Thimothi Prakasha Rao is the owner and license holder of the petitioner saw mill, which was established in the year, 1998. Initially, the Saw Mill was having one vertical saw band. Subsequently, on an application made by the license holder to the 3rd respondent, the 3rd respondent vide order dated 14.06.2012, accorded permission for installation of vertical saw band in addition to the existing horizontal saw band subject to the condition that the capacity of the Saw Mill originally sanctioned by the licensing authority shall not be increased. Since then, the petitioner saw mill is being run with one horizontal band and one vertical saw band with a capacity of 30 HP. The license of the Saw Mill was being renewed from time to time by the 3rd respondent and accordingly, renewed up to 31.12.2014.
The application of the petitioner for further renewal is pending before the 3rd respondent. While so, the 3rd respondent issued a show cause notice dated 10.02.2015 stating as to why the permission for installation of the additional machinery should not be cancelled and removed. The present writ petition is, therefore, filed seeking to set aside the proceedings issued by the 3rd respondent. Having regard to the submissions made on either side, the writ petition is disposed of directing the 3rd respondent to pass appropriate orders on the renewal application submitted by the license holder of the petitioner's saw mill at an early date and till then, no coercive steps shall be taken for removal of additional saw band from the petitioner's saw mill. There shall be no order as to costs.
Pending miscellaneous petitions, if any, shall stand closed in consequence.
