THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.41262 of 2015 ORDER:
The prayer of the petitioner in this case is as under: "For the reasons disclosed in the accompanying affidavit, it is prayed that this Hon'ble Court may be pleased to issue a Writ of Mandamus or any other appropriate Writ or Writs, Order or Direction, declaring and setting aside the Order dt 27.11.2015 in Rc.No. B2/671/2015 on the file of the 2nd Respondent, as illegal, arbitrary, without jurisdiction and violative of principles of natural justice ; Award costs and pass such other or further orders as are deemed fit and proper in the circumstances of the case." By the order dated 27.11.2015, the excise authorities suspended the licence of the petitioner - society.
Learned Assistant Government Pleader for Mines and Geology, however, informed this Court that after the institution of this writ petition, the licence of the petitioner - society was itself cancelled under proceedings dated 22.02.2016 of the Prohibition and Excise Superintendent, Mahabubnagar. The said proceedings are placed on record and a copy thereof is furnished to the learned counsel for the petitioner. In the light of this development, the cause in this writ petition no longer survives for consideration on merits. The writ petition is accordingly dismissed leaving it open to the petitioner to avail appropriate remedies in accordance with law as regards subsequent development.
Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
