THE HON'BLE SRI JUSTICE P.KESHAVA RAO WRIT PETITION No.15461 OF 2013 ORDER:

There is no representation on behalf of the petitioners. The prayer sought for in the writ petition is as under: "to issue a writ of mandamus declaring the action of the respondent No.3 in interfering with the civil disputes between the respondent Nos.5 and 6 and the petitioners as illegal, arbitrary and violative of principles of natural justice."

During the course of hearing, the learned Government Pleader appearing for the respondents 1 to 3 placed on record the written instructions. A perusal of the said instructions would indicate that on 24.04.2013 at 1500 hours, one Smt. L.Ramya came to the police station and lodged a complaint stating that one P.Rajshekar attempted to trespass and assault into flat No.2, Ground Floor, Block-A, Sri Balaji PSR Towers, Prakashnagar. On receipt of the said complaint, the Assistant Sub-Inspector of Police, Begumpet Police Station, after making an entry in the General Diary, informed said L.Ramya that the allegations are civil in nature. It is also mentioned in the said instructions that the respondents 4 to 6 filed an application seeking ad-interim injunction and the concerned Court granted status quo orders till 17.06.2013.

In the light of the above, the contention raised by the petitioners that the 3rd respondent is interfering in civil disputes is not correct and the writ petition is liable to be dismissed. Accordingly, the Writ Petition is dismissed. No costs.
