THE HONOURABLE SRI JUSTICE M.S.RAMACHANDRA RAO WP.No.37453 of 2015 ORDER :

Heard the counsel for petitioner and the learned Government Pleader for Civil Supplies (Andhra Pradesh) for respondents.

2. This Writ Petition is filed challenging the seizure of stocks from the business premises of petitioner pursuant to the Mediator's Report dt.27.10.2015, and the consequential action of 2nd respondent in proceeding to dispose of the said stock in open market.

3. The counsel for petitioner states that the allegations against petitioner are frivolous and that even though an application for release of the stock has been filed on 30.10.2015 before 2nd respondent, ignoring the same, the 2nd respondent is disposing of the seized stock.

4. The counsel for petitioner further prays that the seized stock be released to petitioner on furnishing a Bank guarantee for its value as assessed by 2nd respondent.

5. On the other hand, the learned Government Pleader appearing for respondents states that he has no objection if the seized stocks are released to petitioner subject to the petitioner furnishing a bank guarantee for the value of the seized stock as assessed by 2nd respondent to the 2nd respondent.

6. In view of the said submission, the Writ Petition is disposed of

directing 2nd respondent to release the stock seized from petitioner subject to petitioner furnishing a bank guarantee for the value of the said seized stock as assessed by 2nd respondent. No order as to costs.

7. As a sequel, miscellaneous petitions pending, if any, in this Writ Petition shall stand closed.
