THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.38325 OF 2014 ORDER :

This writ petition is filed seeking to issue a writ of mandamus declaring the action of the 2nd respondent in not taking any action in pursuance of the representation made by the petitioner on 20-02-2014 seeking to survey and demarcate the land to an extent of Ac.4-221⁄2 gts. in Sy.No.701 of Janwada village, Sankarpally mandal, Ranga Reddy District, as being illegal and arbitrary and for issuance of consequently directions.

Heard learned counsel for the petitioners and the learned Asst. Government Pleader for Revenue.

Learned Asst. Government Pleader for Revenue submits that as on today no final decree is passed in favour of the petitioners and, therefore, it will be difficult to conduct survey to identify the exact extent of land of the petitioners. In fact this Court on 12-122014 passed the following order:- "The learned counsel for the petitioners seeks a weeks time. The learned Government Pleader for Revenue submits that without any final decree proceedings in a partition suit, where property has not yet been divided by metes and bounds, it will be difficult for the survey department to identify the exact parcel of land, which the writ petition is entitled for." 4.

Inasmuch as no final decree proceedings are said to be passed in the partition suit in respect of the land of the petitioners, the properties entitled by the petitioners are not crystallized. Hence, no relief can be granted to demarcate the land of the

petitioners. It is for the petitioners to approach the concerned Court and to seek for final decree proceedings.

The writ petition is dismissed with the above observations. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, if any, shall stand closed. _______________________________ A.RAJASHEKER REDDY, J Dated: 14-02-2017 Nrg
