This Criminal Appeal is filed by the appellant/complainant to set aside the Judgment dated 28.07.2025 passed in C.C.NI.No.7626 of 2022 in C.C.NI.No.10551 of 2019 by the learned IX Judicial Magistrate of First Class, Hyderabad..

Heard Sri Damodar Mundra, learned counsel appearing on behalf of the appellant as well as Sri Arun Kumar Doddla, learned Additional Public Prosecutor appearing on behalf of the respondent No.6 - State. 3.

Learned counsel for the appellant submitted that the trial Court had passed the Judgment dated 28.07.2025 passed in C.C.NI.No.7626 of 2022 in C.C.NI.No.10551 of 2019 by acquitting the accused Nos.3 to 5 and had convicted only one accused i.e. accused No.2, which is not proper and against the principles of

natural justice. It is further submitted that, as per the Judgment of the Hon'ble Apex Court in the case of M/s. Celestium Financial v. A. Gnanasekaran Etc.1, against the acquittal order, the appellant/complainant can file an appeal and proceed with the same before the Sessions Court.

In view of the above submissions of the learned counsel for the appellant, the Criminal appeal is disposed of granting liberty to the appellant to file the same before the Sessions Court.

Miscellaneous applications, if any pending, shall stand closed.
