THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.6006 of 2011 ORDER:

The grievance of the petitioners in this case was that the Station House Officer, II Town Police Station, Anantapur, was not preventing respondents 3 to 6 from illegally interfering with their possession and enjoyment over the huts situated in survey No.89-2 of Kakkalapalle Village, Anantapur Rural Mandal Anantapur District and not taking steps on their complaint dated 03.02.2011. It is however noticed that respondents 3 to 6 in this writ petition are private parties. The complaint dated 03.02.2011 said to have been filed before the police authorities by the petitioners merely indicates that they perceived a threat from certain third parties and requested appropriate legal action against them.

Perusal of the said complaint does not demonstrate any allegation as to commission of an offence warranting criminal prosecution. The petitioners do not assert that their possession over the subject huts is protected by virtue of any order passed by the competent Court which also require police intervention. In the absence of these ingredients, the complaint by the petitioners that the police were inactive does not hold water.

The writ petition is therefore devoid of merit and is accordingly dismissed.

Pending Miscellaneous Petitions shall also stand dismissed. No order as to costs.
