THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.29910 of 2015 ORDER :
This writ petition is filed to declare the action of the respondents in proceeding to demolish the petitioners residential houses bearing House Nos.3-14-384, 3-14-413, 3-14385, 3-14-411 respectively, situated at Durga Colony, Kakatiya University Road, Hanamkonda, Warangal District, without following the due process of law including the procedure laid down under the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 and the Greater Hyderabad Municipal Corporation Act, 1955, as arbitrary and illegal and consequently direct the respondents not to demolish the residential houses of the petitioners without following the due process of law.
2. Learned Standing Counsel for the 2nd respondent, on instructions, submits that the Municipal Corporation has not put up any markings and is not taking steps to demolish the residential houses of the petitioners for widening of the road as alleged by the petitioners.
3. Having regard to the above submission, the writ petition is disposed of. However, if there is any requirement of properties belonging to the petitioners, for widening of the road, the petitioners cannot be displaced without following the due process of law. There shall be no order as to costs.
Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
