HON'BLE Smt. JUSTICE ANIS Criminal Petition No.14180 of 2016 ORDER:

This Criminal Petition is filed by petitioner, under Section 482 Cr.P.C, seeking quashing of investigation in Crime No.82 of 2016 of Rajam Police Station, Srikakulam District, registered for the offences punishable under Sections 304-A, 338, 337 read with Section 109 I.P.C. and Sections 3,4,5 & 6 of Explosives Substance Act, 1908.

Learned Counsel appearing for the petitioner contends that petitioner is not Accused No.15 in Crime No.82 of 2016 before the Rajam Police Station, Srikakulam District. A perusal of F.I.R. shows that A15 is one, Bathula Ramesh. It is further contended that the petitioner is no way connected with the crime and he is not accused, therefore, prays the Court to grant protection from the Police from arresting the petitioner in connection with crime No.82 of 2016. In view of the facts and circumstances of the case, this Court is not inclined to interfere with investigation. However, the Station House Officer, Rajam Police Station, Srikakulam District, is hereby directed not to arrest the petitioner - Battula Prakash, S/o late Suryanarayana in connection with crime No.82 of 2016 till completion of investigation or, filing of charge sheet or final report. With the above direction, the Criminal Petition is disposed of. Consequently, Miscellaneous Petitions, if any, pending in this Criminal Petition shall stand closed.
