HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO Criminal Petition No.8505 of 2018 ORDER :
The petitioners are the A.1 and A.2 of Cr.No.136 of 2018 of Chirala I Town Police Station registered for the offence punishable u/ sec.363 IPC and from the statement of the victim girl aged about 15 years the crime is altered to Sections 376 and 212 IPC by adding those sections along with Sections 4 and 17 of POCSO Act. The petitioners are seeking regular bail having gone unsuccessful before the learned I Addl.Sessions Judge, Ongole in Crl.M.P.No.450 of 2018, dt.26.07.2018. Heard the learned counsel for the petitioners and the learned Addl.Public Prosecutor for the respondent-State opposing the bail application and perused the First Information Report, bail application averments, remand report of A.1 and A.2 and the Case Diary.
From the investigation, it discloses 15 witnesses were examined so far which shows prima facie accusation against both the accused for grave offence u/ sec.376 IPC against the minor girl, thereby the petitioners are not entitled to the concession of bail. Having regard to the above, the Criminal Petition is dismissed. Miscellaneous petitions, if any, pending in this Criminal Petition, shall stand closed.
