ORDER

Challenging the inaction of the 5th respondent in completing the investigation in Cr.No.85 of 2016, dated 3.4.2016, the present writ petition is filed. A counter-affidavit is filed on behalf of respondents 1 to 5 stating that based on the complaint of the 6th respondent, Cr.No.44 of 2016 was registered on 25.02.2016 against the petitioner and four others. The petitioner sent another complaint dated 25.2.2016 through post and also filed WP No.6985 of 2016 seeking a direction to the respondents to act upon his complaint. The said writ petition was disposed of on 3.3.2016 reiterating the directions of the Apex Court in Lalita Kumari vs. State of U.P.1 In pursuance of the same, the complaint of the petitioner was registered as Cr.No.85 of 2016 on 3.4.2016 against respondents 6 to 8 and investigation was taken up. During the course of investigation, six witnesses were examined, their statements were recorded and further investigation is in progress. On completion of investigation, appropriate report would be filed before the Court concerned. 1 (2014) 2 SCC 1

Since crimes were registered on 25.2.2016 and 3.4.2016 as mentioned in the counter-affidavit, it cannot be said that there is no action on the part of the 5th respondent as alleged by the petitioner. However, the 5th respondent is directed to complete the investigation within three months from the date of receipt of a copy of this order and file a final report before the competent Court in accordance with law.
