THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION Nos.9620 OF 2022 AND COMMON ORDER:

These two Criminal Petitions are filed under Section 438 of the Code of Criminal Procedure, 1973 seeking pre-arrest bail to the petitioners who are arrayed as Accused Nos.7 and 8 in Crime No.116 of 2022 on the file of Station House Officer, Godavarikani II Town Police Station, Peddapalli District registered for the offences punishable under Sections 417, 420 and 306 read with Sections 511 and 34 of Indian Penal Code.

Since the petitioners are Accused Nos.7 and 8 in the same Crime i.e. Crime No.116 of 2022, both the criminal petitions are heard together and disposed off by this common order. 3.

Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the respondent-State. Perused the record.

The case of the prosecution is that the victim paid an amount of Rs.5,90,000/- to Accused Nos.1 and 2. Thereafter the amounts

were distributed in between other accused. Though the job was provided to the victim, he was under the apprehension that he may be removed since the factory was laying off the employees, for the said reason, he attempted to commit suicide.

In the confession of Accused No.4, it is stated that 1,70,000/- was given to these petitioners-Accused Nos.7 and 8. 6.

Though the witnesses were examined none of the witnesses including the victim stated regarding these petitioners. Since the implication of these petitioners is only on the basis of confession of Accused No.4, these petitioners can be granted the relief of anticipatory bail.

Accordingly, both the Criminal Petitions are allowed and the petitioners-Accused Nos.7 and 8 are granted anticipatory bail subject to the following conditions:

i) The petitioners-Accused Nos.7 and 8 are directed to surrender before the of Station House Officer, Godavarikani II Town Police Station, Peddapalli District within ten (10) days from today, and on such surrender, they shall be enlarged on bail on their executing

personal bonds for a sum of Rs.25,000/- (Rupees Twenty Five Thousand Only) each with two sureties to the like sum each, to its satisfaction.

ii) The petitioners-Accused Nos.7 and 8 shall appear before the concerned Station House Officer on every Monday between 10.30 AM and 01.00 PM for a period of eight (08) weeks and thereafter as and when required for the purpose of investigation. iii) The petitioners-Accused Nos.7 and 8 shall abide by the other conditions stipulated in Section 438(2) Cr.P.C.
