HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO Criminal Petition No.8507 OF 2018 ORDER:

The petitioners are A1 & A2, among three accused (A3 stated died), in Crime No.284 of 2018 on the file of Jammalamadugu (U) Police Station, YSR Cuddapah District. The crime is registered for the offences punishable under Sections 420, 506 r/w 34 IPC. 2.

The petitioners went unsuccessful in seeking anticipatory bail before the learned II Additional Sessions Judge, Kadapa at Proddatur vide dismissal order in Crl.M.P.No.1465 of 2018 dated 19.07.2018 in directing to surrender before the learned Judicial Magistrate of First Class, Jammalamadugu and move for regular bail, so that the learned Magistrate shall dispose of the same according to the law on the same day.

Heard the learned counsel for petitioners and the learned Special Assistant Public Prosecutor representing the State of Andhra Pradesh in opposing the same and perused the F.I.R, the bail application averments and the material on record. 4.

From the allegations, this Court could not consider the entitlement to the concession of bail by the petitioners, but for to say for none of the offences are punishable above seven years, the police strictly follow Section 41-A Cr.P.C. apart from availability of the concession granted to them by the learned Sessions Judge referred supra.
