THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.12924 of 2025 This Criminal Petition is filed before this Court for grant of bail to the Petitioner who is arrayed as accused No.1 in FIR No.616 of 2025 of Nagole Police Station, Rachakonda Commissionerate, registered for the offences punishable under Sections 316(2), 318(4) of BNS and Sections 3 and 5 of the Telangana Protection of Depositors Finance Establishment Act, of Nagole Police Station, Rachakonda Commissionerate.

The brief facts of the case are that, on 21.08.2025, the de-facto complainant lodged a report before the police stating that the petitioner herein engaged the de-facto complainant to invest in Mama Metals, wherein he showed the complainant gold coins and gold biscuits. Believing his words, in the month of January 2024, complainant invested Rs.10,00,000/- in his office and in February Rs.15,00,000/-. Again, on 13.03.2024, he gave him Rs.25,00,000/-, and on 02.04.2024, Rs.25,00,000/-, towards further investment. Thereafter, the accused herein not responded to his calls and not answered, when he questioned him. Hence, he requested to take

necessary action. Basing on the said complaint, the police registered a case for the above said offences. 3.

Heard Sri Ramesh Kumar Boddu, learned counsel appearing on behalf of the petitioner/accused No.1 as well as Sri Arun Kumar Doddla, learned Additional Public Prosecutor for respondent-State.

Learned counsel for the petitioner submitted that the petitioner is innocent of the alleged offences and he is falsely implicated in the case. It is further submitted that he never induced any person and accused No.2 is the main accused, according to the remand case diary, he died in judicial custody on 27.08.2025. It is further submitted that he is in jail from 22.08.2025 and the material part of the investigation was already completed. Therefore, he prayed the Court to grant bail to him by allowing this criminal petition. 5.

On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioner stating that the allegations leveled against him are serious in nature. It is further submitted that number of victims were suffered in the hands of the petitioner herein and he is also involved in other case in Crime No.532 of 2025. At

this stage, grating of bail to the petitioner does not arise. Therefore, he prayed the Court to dismiss the criminal petition.

In the light of the submissions made by both the learned counsel and upon perusal of the material available on record, it appears that the petitioner is in jail from 22.08.2025. Further, as seen from the record, the material part of the investigation was already. Considering the facts and circumstances of the case, the nature of the allegations, the stage of investigation, and the duration of incarceration, this Court finds it appropriate to grant bail to the petitioner/accused No.1, subject to the following conditions. i.

The petitioner/ accused No.1 shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each, with two sureties for a like sum each to the satisfaction of the learned I Additional Junior Civil Judge-cum-I Additional Judicial Magistrate of First Class at L.B. Nagar, Ranga Reddy District.

ii.

The petitioner/ accused No.1 shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) week or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.

iii.

The petitioner/ accused No.1 shall abide by the conditions stipulated in Section 437(3) of Cr.P.C. (presently, Section 480(3) of the BNSS).

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
