HONOURABLE SRI J USTICE CHALLA K ODANDA RAM WRIT PETITION No. 4415 OF 2017 ORDER:

The petitioner challenges inaction on the part of respondents 2 and 3 in not processing her application vide Lr.No.3/C12/00120/2017 dated 17.01.2017 for construction of a house in premises bearing Plot No.39, admeasuring 250 square yards situate in Block No.1, Southern part of the land in Sy.No.78, Sri Sai Hills, Venkatramna Colony, Gokul Plots, Hafeezpet Village, Serilingampally Mandal, Ranga Reddy District and also insisting No Objection Certificate from Respondent No.4 as illegal and arbitrary.

As can be seen from the impugned order dated 17.01.2017, certain deficiencies/shortfalls have been pointed out, specifically stating therein as follows:

In view of the above, the proposals are refused and the plans are returned unapproved without any sanction and you shall not

commence any type of construction till the specific sanction is obtained from GHMC. "

In other words, as submitted by Sri Sampath Prabhaka Reddy learned Standing Counsel appearing for the respondentsGHMC, what at all the petitioner required to do is to approach the respondent authorities and make good of the deficiencies/shortfalls , In the circumstances, giving opportunity to the petitioner to approach the respondent authorities and fulfill the deficiencies/shortfalls, the Writ Petition is disposed of. It is made clear that as and when deficiencies/shortfalls are complied with, the respondents shall consider and process the application of the petitioner in accordance with law.

Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed in consequence. No order as to costs.
