Heard learned counsel for the petitioners and learned Standing Counsel for Singareni Collieries Company Limited. 2.

Late Kama Ravi Raju died while he was in service. His wife, by name, Kama Swetha filed application seeking to provide employment on compassionate grounds to her brother-in-law, by name, Kama Rajesh. By the order impugned, the request of Kama Swetha was rejected by the respondent - Company. It was informed that such provision does not exist and the claim to provide employment to her brother-in-law/brother of late employee is not valid. Further, she was advised to seek employment to herself or dependant employment to any eligible male dependant as per guidelines.

No scheme is brought to my notice, which enables provision of employment to brother of late employee after his marriage and more so when his wife is alive. Dependant employment is provided to family members like wife or children only but not to any other person. Thus, I do not see any illegality in refusing to provide employment to brother of late employee.

The Writ Petition is accordingly dismissed. There shall be no order as to costs. Pending Miscellaneous Petitions, if any, shall stand closed.
