THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.12941 of 2025 ORDER:

This Criminal Petition is filed seeking the Court to enlarge the petitioner, on bail, who is arrayed as accused No.6 in Crime No.499 of 2025 of Bhupalpally Police Station, Jayashankar Bhupalpally District.

The brief facts of the case are that a complaint lodged on 04.09.2025 by one Md. Sabiya, alleging that her son Md. Bashith was kidnapped by accused persons near Shanthinagar Church, Bhupalpally, on 03.09.2025. It was stated that after meeting a lawyer, the victim, along with his friend Mekala Arun, was intercepted by accused Nos.1 to 3 and others, who assaulted and kidnapped him.

Heard Sri Allu Midhun Kumar, learned counsel appearing on behalf of the petitioner as well as Sri D. Arun Kumar, learned Additional Public Prosecutor appearing on behalf of the respondent - State.

Learned counsel for the petitioner submitted that the petitioner was falsely implicated two days after the incident

without any direct evidence linking him to the alleged offence and that the entire investigation was substandard and that the inclusion of the petitioner was based only on conjecture and the statements of co-accused. He further submitted that the investigation was already completed, and all material evidence, including witness statements and medical reports, had been collected. He contended that the petitioner is in jail since 06.09.2025. Therefore, he prayed the Court to grant bail to the petitioner by allowing this criminal petition. 5.

On the other hand, learned Additional Public Prosecutor opposed the bail stating that the allegations leveled against the petitioner are serious in nature. He further submitted that the investigation was not yet completed. At this stage, granting of bail to the petitioner does not arise. Therefore, he prayed the Court to dismiss the criminal petition. 6.

In the light of the submissions made by both the learned counsel and a perusal of the material available on record, it appears that though the learned counsel for the petitioner contended that there are no specific overt acts attributed to the petitioner and that he has been falsely implicated without any cogent evidence, the case diary and

remand report disclose that there was a criminal conspiracy among accused Nos.1 to 6 to kill the victim. The allegations leveled against the petitioner are, therefore, grave and serious in nature. At this stage of investigation, this Court does not find it a fit case to grant bail to the petitioner. Therefore, criminal petition lacks merit and the same is liable to be dismissed.

Accordingly, this criminal petition is dismissed. Miscellaneous applications, if any pending, shall stand closed.
