S. Srinivasa Murthy v. The State Of Andhra Pradesh,
THE HON'BLE SRI JUSTICE C.V.NAGARJUNA REDDY WRIT PETITION No.11160 of 2015 09.07.2015 Between:
S.Srinivasa Murthy
...Petitioner
And The State of Andhra Pradesh, represented by its Chief Secretary, Hyderabad and others
...Respondents
Counsel for the petitioner: Mr.K.Ramachandra Counsel for respondent Nos.1 and 2: Mr. Ramesh Special Government Pleader The Court made the following:
ORDER:
This writ petition is filed for a mandamus to declare the action of respondent No.2 in establishing a separate organization viz., Environment Protection Training and Research Institute (EPTRI) for the State of Andhra Pradesh, though the said institution is included in the 10th Schedule of the Andhra Pradesh Reorganization Act, 2014. Though, I am not convinced on the merits of the case pleaded by the petitioner, the necessity of adjudicating the writ petition on merits is obviated for the reason that the petitioner has retired from service on attaining the age of superannuation after filing of this writ petition. The learned counsel for the petitioner is unable to state as to how the petitioner's interests will continue to suffer after his retirement if the newly created institution is allowed to exist. Therefore, it is unnecessary to adjudicate the writ petition on merits as the cause which the petitioner sought to espouse in the writ petition ceases to be available to him on his retirement.
For the aforementioned reasons, the Writ Petition is dismissed. As a sequel to dismissal of this writ petition, W.P.M.P.No.14762 of 2015 filed by the petitioner for interim relief shall stand dismissed as infructuous.
