THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.9686 OF 2022 O R D E R:

This Criminal Petition is filed under Section 438 of the Code of Criminal procedure, 1973 seeking pre-arrest bail to the petitioner who is arrayed as Accused No.5 in the event of her arrest in Cr.No.331 of 2022 on the file of Station House Officer, Asifnagar Police Station, Hyderabad, registered for the offences punishable under Sections 8(c) read with 20(b)(ii)(B) of Narcotic Drugs and Psychotropic Substances Act, 1985.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent-State. Perused the record.

The Asifnagar Police apprehended Accused No.1 and found 1.2 kgs of dry ganja. During the course of investigation, on the basis of his confession, it was found that Accused Nos.2 to 5 were suppliers and Accused Nos.6 to 46 are consumers. 4.

Keeping in view that the only basis for arraying this petitioner who is the mother of Accused No.1 is the confession of Accused

No.1. Therefore, this petitioner can be granted the relief of anticipatory bail.

Accordingly, the Criminal Petition is allowed and the petitioner-Accused No.5 shall be enlarged on bail in the event of her arrest subject to the following conditions:

i) The petitioner-Accused No.5 is directed to surrender before the Station House Officer, Asifnagar Police Station, within ten (10) days from today, and on such surrender, she shall be enlarged on bail on her executing personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand Only) with two sureties to the like sum each, to its satisfaction.

ii) On such release, the petitioner-Accused No.5 shall appear before the concerned Station House Officer on every Monday for a period of four (04) weeks and thereafter as and when required for the purpose of investigation.

iii) The petitioner-Accused No.5 shall abide by the other conditions stipulated in Section 438(2) Cr.P.C.
