THE HON'BLE SRI JUSTICE T.AMARNATH GOUD CRIMINAL PETITION NO.7130 OF 2011 ORDER:

This Criminal Petition is filed under Section 482 of the Criminal Procedure Code to quash the proceedings in C.C.No.506 of 2006 on the file of Judicial Magistrate of First Class, Shadnagar under Sections 419, 420, 468 r/w 109 IPC.

A perusal of the First Information Report No.236 of 2005, dated 28.07.2005, discloses that altogether there are 18 accused. Petitioners herein are A7, A8 and A12. It is brought to the notice of this Court that, except the petitioners herein, all the other accused filed several Criminal Petitions before this Court and this Court allowed the said Criminal Petitions by setting aside the crime against them. Crl.P.No.4751 of 2007, filed by A1, was allowed on 28.03.2008; Crl.P.No.8456 of 2010, filed by A4, A13 and A15, was allowed on 29.12.2010; Crl.P.No.12722 of 2010, filed by A16, was allowed on 22.12.2010 and Crl.P.No.1162 of 2011, filed by A5, A14 and A17, was allowed on 08.02.2011. Insofar as the allegations pertaining to the petitioners herein, in the charge sheet, there is no specific case made out to implicate them under Sections 419, 420, 468 r/w 109 IPC.

For the reasons stated above, the Criminal Petition is allowed, setting aside the proceedings in C.C.No.506 of 2006 on the file of the Judicial Magistrate of First Class, Shadnagar insofar as the petitioners herein are concerned. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
