IN THE HIGH COURT OF JUDICATURE AT HYDERABAD

FOR THE STATE OF TELANGANA AND THE STATE OF ANDHRA PRADESH **** WRIT PETITION NO.38096 OF 2012 DATED 31st AUGUST, 2015 Between:

Tulasi Dharma Charan .. Petitioner and The Superintendent of Police, Guntur District and another .. Respondents

THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION NO.38096 OF 2012

O R D E R

The grievance of the petitioner was that the police authorities were not taking further action after registration of Crime No.282 of 2012 on the file of Arundalpet Police Station, Guntur.

Relying on the written instructions dated 17.08.2015 received from the Sub-Inspector of Police, Arundalpet Police Station, Guntur Urban District, the learned Assistant Government for Home informed this Court that Crime No.282 of 2012 was registered on the file of Arundalpet Police Station under Sections 409 and 420 read with Section 34 IPC.

Upon thorough enquiry and investigation, the police authorities found that the issue was purely civil in nature and upon obtaining permission from the Sub-Divisional Police Officer, West Sub-Division, Guntur Urban District, a final report was filed before the learned V Additional Junior Civil Judge, Guntur, on 17.08.2015 referring the case as 'noncognizable'. A copy of the intimation given to the petitioner in Form 70 was also filed.

In the light of the aforestated facts, the grievance of the petitioner that the police authorities were not investigating Crime No.282 of 2012 on the file of the Arundalpet Police Station, Guntur, is shown to be without basis. In the event the petitioner is aggrieved by the final conclusion arrived at by the police authorities, it is for him to take recourse to appropriate remedies in accordance with law. Reserving liberty to the petitioner to do so, the writ petition is dismissed. Pending miscellaneous petitions shall also stand dismissed. No order as to costs.
