HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.27897 of 2016 ORDER:
This writ petition is filed under Article 226 of the Constitution of India seeking a writ of Mandamus declaring the action of the respondents 1 to 4 in laying the high tension electrical lines through the lands of the petitioner as illegal and arbitrary.
2. Heard the learned counsel for the petitioner, Sri N.Siva Reddy, learned Standing Counsel for Transco(Andhra Pradesh) and the learned Government Pleader for Revenue(Andhra Pradesh).
3. The petitioner claims that he is the owner of an extent of Ac.1.04 cents in Survey No.90-2, Ac.2.46 cents in Survey No.92 and Ac.10.13 cents in Survey No.93 at Manesamudram village, Hindupur Mandal, Anantapur District. Learned counsel for the petitioner submitted that the respondents are laying high tension electrical lines through the lands of the petitioner, by changing original alignment, without following the due procedure. Sri N.Siva Reddy, learned standing counsel for respondents 1 to 4 submitted that the respondents have not changed the alignment as contended by the petitioner.
4. At the time of arguments, both counsel with one voice submitted that this writ petition may be disposed of in terms of writ petition No.23328 of 2016.
5. Having regard to the facts and circumstances of the case and also the submissions made by both counsel, the respondents are hereby directed to pay compensation to the petitioner in
accordance with law, if the high tension electrical lines are laid through the lands of the petitioner.
6. With the above direction, this writ petition is disposed of. No order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
