THE HON'BLE SRI JUSTICE SANJAY KUMAR CONTEMPT CASE NO.558 OF 2015

O R D E R

This contempt case was instituted alleging willful disobedience to the order dated 22.04.2013 in so far as it related to W.P.No.12057 of 2013. By the said order, this Court disposed of a batch of writ petitions directing the registering authorities concerned to receive and process the documents presented by the petitioners in the cases without insisting upon 'no objection certificates'. If the registering authority concerned was of the opinion that the document presented for registration warranted denial, he was given liberty to pass orders in writing indicating the reasons for such refusal and communicate the same to the party.

Alleging that the respondent herein, the Joint Sub-Registrar, Mancherial, failed to abide by the above said order, the present contempt case is filed. The respondent filed additional affidavit dated 04.12.2015, wherein he categorically stated that no document was presented for registration before his office and only a clarification was sought by the petitioner as to whether the document would be registered if presented.

As the order passed by this Court was to come into operation only upon presentation of the document for registration and as this Court cannot resolve the disputed question of fact as to whether a document was, in fact, presented for registration in exercise of contempt jurisdiction, no adjudication is warranted in the present contempt case.
