With the consent of both the parties, the writ petition itself is disposed of at the admission stage.

The present writ petition is filed seeking issuance of a writ of mandamus declaring the action of respondent Nos.1 and 2 in not issuing copies of any orders passed by them in Appeal bearing Nos. 230/2008 to 235/2008 inspite of copy applications filed by them, as illegal and arbitrary. Heard learned counsel for the petitioners and learned counsel for the respondents.

The counter affidavit filed by the Revenue Divisional Officer would indicate that the petitioners filed the appeal beyond the prescribed period of limitation and they did not file any petition to condone the delay in preferring the appeal. The said fact is not disputed by the learned counsel for the petitioners. Therefore, the question of furnishing copy of the orders would not arise. However, the averments in the counter affidavit would show that the land was resumed as the same was sold by the original assignees in violation of the rules and conditions incorporated in patta. In view of the above, nothing survives in the present writ petition and the same is accordingly dismissed. No order as to costs. Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
