This writ petition was filed for the following relief: "...to issue an appropriate Writ, Order or direction, preferably one in the nature of Writ of mandamus, declaring the action of the 3rd respondent in not taking any action on the representation of the petitioners dated 09-01-2015 to appoint a Special Officer for conduct of the auction over the fish fetched by the members of the 6th respondent Society by allowing the 6th respondent alone to dispose of the fish in the auction as arbitrary, illegal and contrary to law and consequently direct the 3rd respondent herein to appoint a Special Officer to supervise the auction to be conducted by the 6th respondent in respect of fish fetched by the members of the 6th respondent Society forthwith in the o interest of justice and pass...."
In view of the passage of time the relief sought in the writ petition has become infructuous apart from the locus standi of the petitioners to challenge the action of the 3r d respondent. In the circumstances, the petitioner seeks to withdraw the writ petition with liberty to take appropriate legal proceedings as and when fresh cause of action arises.
In view of the same, the writ petition is dismissed as withdrawn. No order as to costs. As a sequel, miscellaneous petitions, if any, shall stand closed.
