HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.28747 OF 2018 ORDER:
The present writ petition came to be filed seeking to declare the action of the respondents in threatening the petitioner to vacate the tin shed situated at Plot No.36, Sy.No.181 of China Mushidiwada Village, Pendurthi Mandal, Visakhapatnam District and also trying to demolish the same highly handedly without following the due process of law, as illegal and arbitrary.
Heard the learned counsel for the petitioner and the learned Government Pleader for Revenue.
Though various grounds are urged in the writ affidavit, the learned counsel for the petitioner submits that the respondents are trying to vacate the petitioner from the tin shed raised by her, forcefully and also trying to demolish the same without following the due process of law. According to him, the petitioner was assigned the said plot in the month of October, 1996 and since then she has been in possession and enjoyment of the same. The petitioner has also raised a tin shed in the said plot and staying there, but for reasons best known, the 4th respondent-Tahsildar along with the other officials are trying to demolish the said tin shed and dispossess the petitioner highly handedly. Learned Government Pleader for Revenue would submit that the documents filed by the petitioner along with the writ petition do not indicate that the petitioner is in possession of the same. Having regard to the facts and circumstances of the case and without going into merits of the case, the writ petition is disposed of directing the respondents not to interfere with the possession and
enjoyment of the petitioner's tin shed if the petitioner is in possession except following the due process of law.
With the above direction, the writ petition is disposed of. No order as to costs. As a sequel to disposal of the writ petition, WP.M.Ps if any pending shall stand closed.
