THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION Nos.11797 OF 2023 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by the petitioner/Accused Nos.2 and 3 seeking bail in the event of their arrest in connection with Crime No.63 of 2023 on the file of Itikayala Police Station, Jogulamaba Gadwal District, registered for the offences under Sections 366, 376(2) of IPC and Section 5(1) r/w. 6 of POCSO Act, 2012.

Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the respondent-State and perused the record.

The case of the Itikayala Police is that A-1 had lured the victim girl who is aged around 17 years and took her on 13.06.2023. Thereafter, he dropped her on 19.06.2023. Prior to that victim girl and A-1 were studying together and A-1 had promised to marry her.

The allegation against these petitioners, who are mother and paternal Uncle of A-1 is that they helped A-1 when eloped with the victim girl.

Since the only allegation against these petitioners is that they have supported A-1, the relief of anticipatory bail can be granted, subject to following conditions:-

1) The petitioners/Accused Nos.2 and 3 are directed to surrender before the Station House Officer, Itikayala Police Station, Jogulamba Gadwal District, on or before 13.12.2023. Upon such surrender, the said Station House Officer shall release the petitioners/Accused on bail, on their executing personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties, for a like sum each to his satisfaction.

2) On such release, the petitioner No.1/Accused No.2 shall appear before the concerned Station House Officer for the purpose of investigation, as and when required. As far as petitioner No.2/A-3 is concerned, he shall appear before the concerned SHO for a period of four weeks for the purpose of investigation and thereafter, as and when required.

3) The petitioners/accused Nos.2 and 3 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case.

Accordingly, the Criminal Petition is allowed.

Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
