THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.9631 OF 2022 O R D E R:

This Criminal Petition is filed under Section 438 of the Code of Criminal Procedure, 1973 (for short "Cr.P.C.") seeking pre-arrest bail to the petitioner, who is arrayed as Accused No.4, in the event of her arrest in connection with Crime No.449 of 2022 of Mills Colony Police Station, Warangal District, registered for the offences punishable under Sections 498-A, 304-B of the Indian Penal Code and Sections 3 and 4 of the Dowry Prohibition Act.

Heard learned counsel for the petitioner/Accused No.4 and learned Additional Public Prosecutor for the respondentState. Perused the record. 3.

The case of the prosecution is that the deceased Dongala Bhavani is the wife of Accused No.1 and after marriage Accused No.1 started harassing the deceased demanding additional dowry. Unable to bear the harassment meted out by Accused No.1 and parents-in-law, she died consuming pesticides poison. It is mentioned in the Remand Report of Accused No.1 that

Accused Nos.2 and 3 and this petitioner/Accused No.4, who is sister of Accused No.1, have instigated the harassment. 4.

In the said circumstances, when there are no specific allegations against this petitioner/Accused No.4 and the case against this petitioner/Accused No.4 is that she instigated Accused No.1, the prayer for granting anticipatory bail can be considered, more so, for the reason of the petitioner/Accused No.4 was married and working in Hyderabad.

Accordingly, the Criminal Petition is allowed and the petitioner/Accused No.4 is granted anticipatory bail subject to the following conditions:

i) The petitioner/Accused No.4 is directed to surrender before the of Station House Officer, Mills Colony Police Station, Warangal District, within ten (10) days from today, and on such surrender, she shall be enlarged on bail on her executing personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand Only) with two sureties to the like sum each, to its satisfaction.

iii) The petitioner/Accused No.4 shall abide by the other conditions stipulated in Section 438(2) Cr.P.C.

Pending miscellaneous applications, if any, shall stand closed.
