ORDER

This writ petition is filed seeking the following relief: "..to issue an order or direction or writ specially writ of Mandamus by setting aside proceedings No.DEE/OP/NLG/Adm/UI/F.D.No.705/2004, dated 29.5.2004 of the 1st respondent in so far as promotion of 2nd respondent is concerned by declaring the same as illegal and consequently direct the 1st respondent to promote the petitioner as Line Inspector by granting attendant and ancillary benefits and pass such other or further orders as the Hon'ble Court deems fit and proper."

Learned counsel appearing for the petitioner submits that though the petitioner is more meritorious and senior to the 2nd respondent, the 1st respondent had ignored his case, promoted the 2nd respondent as Line Inspector and that appropriate orders be passed by setting aside the promotion of the 2nd respondent and consider the case of the petitioner for promotion to the post of Line Inspector.

Having considered the said submissions, this Writ Petition is disposed of directing the 1st respondent to consider the case of the petitioner for promotion in any existing vacancy, if not already promoted, in accordance with Rules and pass appropriate orders within a period of four weeks from the date of receipt of a copy of this order. No costs.

Miscellaneous petitions, if any, pending shall stand closed.
