THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CRIMINAL PETITION No.13105 OF 2015 ORDER:

1 This petition is filed under Section 482 Cr.P.C to quash the proceedings against the petitioner/accused in C.C.No.480 of 2008 on the file of II Metropolitan Magistrate (Railway Court), Vijayawada.

2 At the time of arguments, the learned counsel for the petitioner has sought permission of the Court to permit the petitioner to withdraw this Criminal Petition, with liberty to avail the remedies available to him under law, including filing of petition under Section 70(2) Cr.P.C to recall the NBW issued against him on 05.11.2015.

3 Permission is accorded.

4. In the result, the Criminal petition is dismissed as withdrawn, granting the liberty as prayed for. However, the trial Court is directed to dispose of the petition to be filed by the petitioner under Section 70(2) Cr.P.C. on the same day taking into consideration the facts and circumstances of the case and in accordance with law. As a sequel, the miscellaneous petitions, pending if any in this Criminal Petition, shall stand closed.
