SMT. JUSTICE T. RAJANI CRL.PETITION NO. 13495 OF 2011 O R D E R :

This Criminal Petition is filed seeking quash of the Proceedings in Crime No. 826 of 2011 of Pujagutta Police Station, Hyderabad district, which is registered for the offences under section 406, 420 and 506 of I.P.C.

2. Heard the learned counsel for the petitioner and the learned Public Prosecutor appearing for the first respondent-State.

3. The offences which are alleged against the accused are under section 406, 420 and 506 of IPC.

4. The counsel for the petitioner submits that in the FIR there is absolutely no allegation made against the petitioner, who is A-2. But in the remand case diary, who is shown as accused and the allegation is that he also signed on the challans and invoices, in the absence of A-1. The counsel submits that A-2 is stated to be only a security guard, who does not have any business with the signing of challans and invoices but the case is still at the stage of crime. Unless investigation is taken-up the role of A-2 cannot be understood. The allegation is that the said challans and invoices are fake challans with fake numbers of the lorries.

5. Hence, this court opines that quashing the proceedings at this stage would result in travesty of justice.

6. Hence, in view of the above, this Criminal Petition is dismissed.

7. As a sequel, miscellaneous petitions if any, pending in this Criminal Petition shall stand dismissed.
