THE HON'BLE SRI JUSTICE M.S.K.JAISWAL CRL.P.NO.9978 OF 2016

O R D E R

This criminal petition is filed under Section 482 Cr.P.C. seeking to quash the proceedings in C.C.No.467/2014 on the file of I Additional Chief Metropolitan Magistrate at Hyderabad, registered against the petitioners/accused 1, 2 and 5, for the alleged offences punishable under Sections 384, 447, 509, 120-B read with 34 IPC. Heard the learned counsel for the petitioners and the learned Additional Public Prosecutor appearing for the State. A perusal of the material on record reveals that specific allegations were made against the petitioners. The truth or otherwise of the allegations can only be decided during course of trial. I see no ground to interdict at this stage and quash the proceedings.

In the facts and circumstances of the case and as requested by the learned counsel for the petitioner, the criminal petition is disposed of, directing the trial court to dispose of the case as expeditiously as possible, preferably within a period of six months from the date of receipt of a copy of this order, without insisting the presence of the petitioners 2 and 3 / accused 2 and 5, unless required for any specific purpose. The petitioner No.1 / accused No.1 shall appear before the trial court. Miscellaneous petitions pending if any, shall stand closed. No costs. ------------------------------ M.S.K.JAISWAL,J DATE:12.07.2016 AVS
