THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.12932 of 2025 This Criminal Petition is filed before this Court for grant of bail to the Petitioners who are arrayed as accused Nos.1, 2, 5 and 6 in FIR No.274 of 2025 of Asifabad Police Station, Kumrambheem Asifabad District, registered for the offences punishable under Sections 118(1), 308(2), 324(4), 324(5), 351(2), r/w 190 of the BNS and later, the Sections were altered to Sections 118(2), 308(2), 324(4)(5), 351(2), 109 r/w 190 of the BNS. 2.
The brief facts of the case are that, on 18.08.2025, the de-facto complainant lodged a report before the police stating that he along with his brother-in-law and others went to Chirrakunta to purchase bulls for the purpose of agricultural work and after purchasing of cattle's, they proceeded to their residence and in the meantime, the accused Nos.1 to 7 and some unknown persons rushed to them and abused in most filthy language and attacked them with iron rods and the de-facto complainant and others sustained grievous injuries and the accused
forcibly took amount of Rs.1,80,000/- from him. Hence, he requested to take necessary action. Basing on the said complaint, the police registered a case for the above said offences.

Heard Sri S. Chandra Sekhar, learned counsel appearing on behalf of the petitioners as well as Sri Arun Kumar Doddla, learned Additional Public Prosecutor for respondent-State.

Learned counsel for the petitioners submitted that there is no intention of the petitioners to kill the de-facto complainant and others and they are innocent of the alleged offences and they are in jail from 12.09.2025 and the material part of the investigation was already completed. Therefore, he prayed the Court to grant bail to them by allowing this criminal petition.

On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioners stating that the allegations leveled against them are serious in nature. It is further submitted that the accused Nos.1, 2, 5 and 6 are
habitual offenders and earlier also a crime was registered against them. Further, the investigation was not yet completed and some of the accused are absconding and they have to secure their presence. Therefore, he prayed the Court to dismiss the criminal petition.

In the light of the submissions made by both the learned counsel and upon perusal of the material available on record, it appears that the petitioners are in jail from 12.09.2025. Further, as seen from the record, LWs 1 to 13 witnesses were examined. Though, the learned Additional Public Prosecutor opposed the bail, on the ground, that TIP has to be conducted, as the accused names are mentioned in the Remand Case Diary, there is no need to conduct TIP of these petitioners. Considering the facts and circumstances of the case, the nature of the allegations, the stage of investigation, and the duration of incarceration, this Court finds it appropriate to grant bail to the petitioners/ accused Nos.1, 2, 5 and 6, subject to the following conditions.
i.
The petitioners/ accused Nos.1, 2, 5 and 6 shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each, with two sureties for a like sum each to the satisfaction of the learned Principal Judicial First Class Magistrate, Asifabad, Kumrambheem Asifabad District.
ii.
The petitioners/ accused Nos.1, 2, 5 and 6 shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight
(8) week or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.
iii.
The petitioners/ accused Nos.1, 2, and shall abide by the conditions stipulated in Section
437(3) of Cr.P.C. (presently, Section 480(3) of the BNSS).

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
