THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No. 15063 of 2015 ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for the respondents.

2. This writ petition was filed challenging the action of the 2nd respondent in not releasing the petitioner's Auto bearing registration No.AP 20TA 2454 which is involved in 6-A proceedings. The petitioner filed a petition on 20.04.2015 seeking release of the vehicle and on the said petition, the 2nd respondent passed an order in Memo M.C.No.78/2015 dated 13.05.2015 directing the petitioner to submit bank guarantee for the market value of the vehicle i.e. Rs.41,600/- at which he has purchased the vehicle as second hand from a third person for interim release of the vehicle. The learned counsel for the petitioner submits that the value of the vehicle would not be Rs.41,600/-, but it would be around Rs.30,000/- as it is a second hand vehicle.

In view of the nature of allegations and in the facts and circumstances of the case, the 2nd respondent is directed to release the Auto bearing registration No.AP 20TA 2454 belonging to the petitioner on condition of the petitioner furnishing bank guarantee for Rs.30,000/- (Rupees Thirty thousand only) within one week from the date of receipt of a copy of the order and filing an undertaking that he will not alienate the auto and produce the same as and when required by the 2nd respondent.

3. The Writ Petition is accordingly disposed of. Miscellaneous petitions, if any, pending in the writ petition shall stand closed. There shall be no order as to costs. ________________________________ (A.RAMALINGESWARA RAO, J)
