THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.2251 of 2016 ORDER:
This criminal petition, under Section 482 of the Code of Criminal Procedure, is filed by the petitioner-Accused seeking to quash the proceedings against him in Crime No.651 of 2014 on the file of the Pattabhipuram Police Station, Guntur Urban, Guntur District. Heard and perused the material available on record. The offence alleged against the petitioner is punishable under Section 420 IPC. The truth or otherwise of the above offence can be ascertained during the investigation. Since the material on record prima facie reveals allegations against the petitioner, this Court is not inclined to interfere with the investigation. At this stage, learned counsel for the petitioner submitted that in view of the pendency of the above crime, the petitioner apprehends arrest and also the harassment in the hands of the police.
In view of the above, the police concerned are directed to complete the investigation without arresting the petitioner and file final report, if any, in accordance with law. The petitioner is directed to appear before the Investigating Agency as and when his presence is required and cooperate with the Investigating Agency. With the above directions, the criminal petition is disposed of. Miscellaneous petitions pending in this criminal petition, if any, shall stand closed.
