HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.17314 OF 2017 ORDER:
The grievance of the petitioner in this writ petition is that the respondent authorities are not considering the representation made by him on 16.10.2016 for declaring him as medically unfit by conducting necessary medical tests.
Heard the learned counsel for the petitioner and Sri J. Srinivasa Rao, learned Standing Counsel appearing for respondents 2 and 3.
Learned Standing Counsel submits that the petitioner is going to retire from service on 31.05.2017 and at the fag end of his service, he made a representation on 16.10.2016 for declaring him as medically unfit. He further submits that unless the petitioner has left over service of more than two years, he is not entitled for any benefits even if he is declared as medically unfit. Learned counsel for the petitioner did not dispute the submissions made by the learned Standing Counsel. Since the representation submitted by the petitioner is stated to be pending before the third respondent, this Court is not inclined to go into the merits of the matter and it is for the third respondent to consider and dispose of the said representation in accordance with the relevant rules and regulations, after taking into account the contentions of the learned Standing Counsel. The writ petition is accordingly disposed of directing the third respondent to dispose of the representation dated
16.10.2016 made by the petitioner as indicated above. There shall be no order as to costs.
Pending miscellaneous petitions, if any, shall stand closed in the light of this final order.
