HON'BLE SRI JUSTICE R. SUBHASH REDDY CIVIL REVISION PETITION Nos.4305, 4355 & 4361 of 2015 COMMON ORDER :
As all these revisions are filed by the same parties, they are heard together and are being disposed of by this common order. The petitioners in these revision petitions are plaintiffs in the suit in O.S.No.2402 of 2012 on the file of IX-Junior Civil Judge, City Civil Court, Hyderabad. In the aforesaid suit, three applications, namely, I.A.No.71 of 2015 is filed to reopen the evidence of PW-1, I.A.No.72 of 2015 is filed for recall of PW-1 for further evidence and I.A.No.73 of 2015 is filed for receiving additional documents. All the aforesaid applications are dismissed by orders, dated 24.06.2015. Aggrieved of the same, these revision petitions are filed. I have perused the impugned orders. The aforesaid applications are filed for marking of additional documents of the property involved in O.S.No.
658 of 2009, which is in respect of car parking in the same building, which is the subject matter of present suit. So far as the present suit in O.S.No.2402 of 2012 is concerned, the same is filed with reference to Flat No.501 in 5th floor of the building. Though the documents relate to the same building, this Court is of the view that the petitioners have not stated as to in what way they are relevant for the purpose of giving possession of Flat No.501.
As much as the limited scope of the suit is to ascertain as to who was in possession of the Flat in question as on the date of filing of suit, this Court is of the view that no valid reasons are assigned to allow the applications with the prayers as mentioned above. For the aforesaid reasons, these revision petitions are devoid of
merit and are accordingly dismissed. No order as to costs. Pending miscellaneous applications, if any, shall stand closed. ______________________ R. SUBHASH REDDY, J 9th October 2015 ajr
