HON'BLE SRI JUSTICE M. SEETHARAMA MURTI CIVIL REVISION PETITION No.1125 of 2014 JUDGMENT:
This Civil Revision Petition, under Section 115 of Code of Civil Procedure, by the judgment debtor is directed against the order dated 27.01.2014 of the learned Principal Junior Civil Judge, Kurnool passed in E.A.No.11 of 2014 in E.P.No.448 of 2011 in O.S.No.253 of 2008 filed under Section 151 of the Code of Civil Procedure requesting to grant three (3) months time to pay the balance amount as per the compromise decree.
I have heard the submissions of the learned counsel for the petitioner/judgment debtor and the respondent/decree holder. The learned counsel for the petitioner/judgment debtor would submit that the Revision Petition may be disposed of granting three (3) months time to pay the balance amount of Rs.75,000/- (Rupees seventy five only) with interest. The learned counsel for the respondent/decree holder would submit that three (3) months time is a long time and that, therefore, reasonable time may be granted.
Recording the submissions, the Civil Revision Petition is disposed of granting a time of three (3) months from today to the judgment debtor to pay under proper acknowledgment the entire balance amount with interest and costs to the decree holder. It is made clear that no further extension of time would be granted. Failing such payment within the time now fixed by this Court, it is needless to mention, that the decree holder is at liberty to further proceed with the execution proceedings in E.P.No.448 of 2011.
There shall be no order as to costs.
Miscellaneous petitions, if any, pending in this Civil Revision Petition shall stand closed.
