THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.42462 of 2015 ORDER:

Heard Mr.G.Venkateswara Rao for petitioner and learned Assistant Government Pleader for respondent Nos.1 and 2. 2.

The subject matter of the writ petition is Ac.5.75 cents in Survey No.225 situated at Pedarajupalem Village, C.S.Puram Mandal, Prakasam District.

The case of petitioner is that respondent Nos.1 and 2 granted Darkhast assignment of petition land in favour of Muppalla Narapa Raju-husband of petitioner. According to petitioner, respondent No.2 recorded the name of assignee in the revenue records and also issued pattadar passbook to assignee. After the death of assignee, petitioner being the wife claims to be in possession and enjoyment of petition land. Firstly, the grievance is respondent Nos.1 and 2 are interfering with the possession and enjoyment of assigned land at the instance of respondent Nos.3 and 4. Secondly, if at all there is rival claim set up by respondent Nos.3 and 4 against the assigned land, respondent No.2 ought to examine, survey and demarcate the government land and private land and protect the possession and enjoyment of petitioner. This Court on 30.12.2015 directed respondent No.2 as follows: "So far as the respondent No.2 is concerned, petitioner herself states that she has approached the second respondent on

07.12.2015 requesting him to protect petitioner's possession over the subject land. It is open for the second respondent to examine the request of petitioner and take appropriate steps as sought for by the petitioner."

The Assistant Government Pleader is not posed with the out come of consideration of representation, dated 07.12.2015. To meet the ends of justice, the writ petition can be disposed of by this order. a. The petitioner is given liberty to represent to respondent No.2 on the grievance of dispossession or fixation of boundaries of assigned land by enclosing a copy of this order within four weeks from today.

b. Respondent No.2 is directed to look into the representation, if necessary have the assigned land surveyed, demarcated and possession of petitioner to the assigned land is allowed to be enjoyed without interruption.

The writ petition is disposed of as indicated above. 6.

Miscellaneous petitions, if any, pending, shall stand closed. No order as to costs.
