HONOURABLE SRI JUSTICE M.S.RAMACHANDRA RAO CONTEMPT CASE NO.2177 OF 2018

O R D E R

This Contempt Case is filed alleging willful disobedience to the order dt.14.11.2017 in W.P.No.9439 of 2017.

By the said order, this Court had directed the respondent in the Contempt Case to dispose of the petitioner's application dt.12.06.2016 for issuance of pattadar pass book and title deed and mutate his name in the Revenue Record.

In the counter-affidavit filed by the respondent, he stated that he retired from service on 31.07.2019 and that his successor complied with the order passed by this Court on 22.11.2019. 4.

It is shocking that the respondent had sat on the order passed by this Court without implementing it from 14.11.2017 till he retired from service on 31.07.2019 without doing anything. The explanation given by the respondent for the delay in complying with the order is that he was busy with electoral duty, but this can hardly be a reason for the delay of almost two years in complying with the order. Therefore, the reason given by the respondent for not complying with the order dt.14.11.2017 in W.P.No.9439 of 2017 is rejected. 5.

The Contempt Case is accordingly allowed and the respondent is sentenced to a fine of Rs.2,000/- (Rupees two thousand only) to be

paid within two weeks from today and in default, he shall suffer simple imprisonment for two weeks.
