Order:

This Writ Petition is filed for a Mandamus to declare the action of respondent No.4, in obstructing the movement of the vehicles plied by the petitioner for transporting gravel excavated from his mine through the 1 km., stretch of forest land beyond LC.No.134 of Gollapalem Village, Aluru Mandal, SPSR Nellore District, as illegal and

arbitrary.

After arguing the case, Mr.C.Subodh, learned Counsel representing Mr.O.Manohar Reddy, learned Counsel for the petitioner, sought for permission of the Court to withdraw the Writ Petition with liberty to his client to approach the competent authority under the extant statutory provisions for grant of permission for transportation of the excavated gravel through the reserve forest. The learned Counsel, however, requested that interim order, dated 05-12-2012, which is subsisting, may be extended for a period of three months to enable his client to approach the competent authority and secure permits.

The above request of the learned Counsel for the petitioner is accepted and the Writ Petition is, accordingly, dismissed as withdrawn with liberty to the petitioner in terms of the prayer made. Interim order, dated 05-12-2012, in WPMP.No.47590 of 2012, shall continue for a period of three months from today.

As a sequel to dismissal of the Writ Petition,

WVMP.No.1076 of is disposed of as infructuous and WPMP.No.47590 of 2012 is disposed of.
