THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.31491 OF 2016 ORDER:

The petitioner, who states that he completed Bachelor of Business Management (B.B.M) and Master of Business Administration (M.B.A), is intending to go abroad for further studies. In the meanwhile, F.I.R.No.159 of 2012 was registered by the fourth respondent showing the petitioner as accused. A charge sheet was also filed and it was numbered as C.C.No.624 of 2012. Subsequently, he was acquitted on 20.03.2015. Based on the said crime, a Rowdy Sheet was opened against him and when the same was continuing, the present writ petition is filed.

The learned Government Pleader filed a counter affidavit, wherein it is stated that the petitioner is a problematic person and he is involved in two cases. As per the counter affidavit, he was involved in crime No.159 of 2012, which ended in acquittal on 19.03.2016. Crime No.49 of 2013 is a bound over case and the period mentioned therein was over. The counter affidavit is filed on 06.10.2016 and in the normal circumstances, the case of the petitioner should have been reviewed in December, 2016.

Since the Rowdy Sheet is being continued and there are no cases pending against the petitioner, the third respondent is directed to consider the case of the petitioner and pass appropriate orders for closure of the Rowdy Sheet within thirty (30) days from the date of receipt of copy of this order. The writ petition is accordingly disposed of. Miscellaneous petitions, if any, pending in the writ petition shall stand closed. __________________________ A.RAMALINGESWARA RAO, J 27.03.2017 pln
