HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR W.P.No.1859 of 2015 ORDER:

Heard.

The grievance of the petitioner in this writ petition is that the 3rd respondent is harassing him, though no crime is registered against him. Learned Government Pleader has received instructions from the 3rd respondent, which state that one Pattu Varalakshmana Joshikumar and another filed a private complaint against the petitioner and others before the Judicial First Class Magistrate, Jangareddygudem. After receipt of the complaint, a case in Cr.No.132 of 2014 was registered on 20-11-2014, wherein the petitioner is shown as A2. It is also stated that the petitioner as well as A3 obtained anticipatory bail on 02-01-2015 in Crl.M.P.No.1659 of 2015 from the Additional District Judge, Kovvur. Thus, it is stated that though this writ petition is filed on 02-02-2015, crime as aforesaid, was registered against the petitioner on 20-11-2014 and the investigation in the said case is pending. Hence, the petitioner's presence is required only for the purpose of investigation, which does not amount to interference or harassment.

Since the petitioner has to co-operate with the investigation, it cannot be said that there is unlawful interference by the 3rd respondent. The writ petition is, therefore, disposed of directing the 3rd respondent to complete the investigation in Cr.No.132 of 2014 and take appropriate further steps in accordance with law expeditiously. No order as to costs. The miscellaneous petitions, if any, pending in this writ petition shall stand closed.
