THE HON'BLE SMT. JUSTICE LALITHA KANNEGANTI WRIT PETITION No.40268 of 2022 O R D E R:

The writ petition is filed seeking the following relief: "... to issue an appropriate writ, order or direction more particularly one in the nature of WRIT OF MANDAMUS declaring the inaction of the Respondents herein in not taking any action on the Representation made by the Petitioner herein dated 20.08.2022 as illegal, arbitrary and against the fundamental rights enshrined in Article 21 and consequently direct the respondents to lay the proper roads restoring the earlier condition of roads from road no.5 to 8, Kamalanagar, Vanasthalipuram, Hyderabad and ....".

Ms. S. Roja Ramani, learned counsel for the petitioner submits that the petitioner gave a representation on 20.08.2022 stating that the roads of Kamalanagar from Road No.5 to 8 were dug for pipeline works long back and the municipal authorities have completed the pipeline work and have closed the pits with mud in unequal level and the roads are damaged with large open pits. It is stated that the petitioner has requested the respondent to take action and restore the road. She submits that in spite of the said representation, no action has been taken by the respondents. 3.

Mr. M. Durga Prasad, learned standing counsel for the respondent municipality submits that they have already called for the tenders and a letter of acceptance was issued on 15.10.2022 asking the contractor to start the work immediately.

Recording the said submission of the learned standing counsel, the writ petition is disposed of. There shall be no order as to costs.

The Miscellaneous Applications, if any shall stand automatically closed.
