THE HON'BLE SRI JUSTICE RAMESH RANGANATHAN AND THE HON'BLR SRI JUSTICE S.RAVI KUMAR WRIT PETITION NO.26294 OF 2015 ORDER: {Per the Hon'ble Sri Justice Ramesh Ranganathan} Sri B.Chandrasen Reddy, learned counsel for the petitioners, would draw our attention to the order of the Debts Recovery Tribunal, Kolkata (DRT), in I.A.No.614 of 2015 in S.A.No.197 of 2015 dated 24.08.2015, whereby the respondent was directed to defer the sale and the sale notice dated 27.07.2015 till the next date of hearing, subject to deposit of Rs.25,00,000/- by the applicant. Learned counsel would submit that, while the petitioners intend to question the condition imposed by the DRT of deposit of Rs.25,00,000/- in independent writ proceedings, the cause in this Writ Petition does not survive, and they be permitted to withdraw the Writ Petition with liberty to question the order of DRT.
