HONOURABLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.33685 of 2012 ORDER:

This writ petition was filed challenging the inaction of the 1st respondent to safeguard the municipal road margin site situated in Kandikatlavari street, Bhimavaram Municipality, West Godavari District.

This Court, while issuing notice on admission on 30.10.2012, observed that the pendency of the writ petition will not disable the 1st respondent from examining the representation/notice given by the petitioner on 21.02.2012 and taking any action found to be necessary thereon.

A counter-affidavit was filed by the 1st respondent stating that when the 2nd respondent erected a bamboo wall in front of her house, the Municipality removed it for free flow of traffic on the road and the 2nd respondent never made any further construction of bamboo mat compound wall in front of her house.

In view of the aforesaid averment made in the counteraffidavit of the 1st respondent, no further orders are required to be passed in the present writ petition. The Writ Petition is accordingly dismissed as infructuous. No order as to costs.
