HONOURABLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.10482 OF 2007 ORDER:

When this matter is taken up for hearing, it has been contended by the learned Counsel for the petitioner that he was an employee of the respondents, and without giving any opportunity to him, the respondents discontinued his services, and challenging the same, the petitioner filed I.D.No.122 of 2006. Further, it has been contended by the learned Counsel for the petitioner that the petitioner filed I.A.Nos.86 and 87 of 2007 in the above I.D.No.122 of 2006 before the 4th respondent challenging the action of the respondents in evicting the petitioner from the quarters and also disconnecting water and electricity supply of the quarters, and that the Labour Court dismissed the said I.As preferred by the petitioner and challenging the same, the petitioner filed the present writ petition.

Further, it has been contended by the learned Counsel for the petitioner that I.D No.122 of 2006 was dismissed by the 4th respondent on 14.11.2011, and no relief was granted in favour of the petitioner, and challenging the same, the petitioner filed W.P.No.7976 of 2012 and the said writ petition is pending before this Court. It has been contended by the learned Counsel for the petitioner that this writ petition must be tagged
on to the writ petition where the petitioner challenged the final orders passed in I.D.No.122 of 2006.

Considering the above submissions, this Court is of the view that if the petitioner succeeds in W.P.No.7976 of 2012, he will be entitled for all the benefits, and for the present, the petitioner cannot squat on the company quarters. There are no merits in this petition.

Accordingly, the Writ Petition is dismissed. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
