HON'BLE SRI JUSTICE SANJAY KUMAR Writ Petition No.5750 of 2011 O R D E R:

This writ petition was filed assailing the alleged inaction on the part of the police authorities in conducting a proper investigation into Crime No. 51 of 2011 on the file of the Nacharam Police Station, Cyberabad, Ranga Reddy District.

The petitioner is the wife of the 4th respondent and daughter-in-law of the 5th respondent. Crime No. 51 of 2011 was registered under Sections 307, 420 and 498-A I.P.C. read with Sections 3 and 4 of the Dowry Prohibition Act, 1961. The Inspector of Police, Nacharam Police Station, Cyberabad Commissionerate, filed a counter affidavit stating that upon investigation, it was found that no prima facie case was made out against the accused that they had committed offences punishable under Sections 307, 420 and 498-A I.P.C. read with Sections 3 and 4 of the Dowry Prohibition Act, 1961. None of the witnesses supported the version of the complainant-petitioner and a final report under Section 173 Cr.P.C. was filed before the learned X Metropolitan Magistrate, Cyberabad, in June,2011 itself.

Sri N. Ravi Prasad, learned counsel appearing for respondent Nos.4 and 5, states that the case was thereupon closed by the Court. He further states that the petitioner had obtained a divorce from the 4th respondent and that all their disputes were settled out of Court.

The petitioner's grievance in this case was only with regard to the alleged failure on the part of the police authorities in investigating the crime. The said grievance is demonstrated to be without basis by virtue of the counter averments which remain un-rebutted. No cause survives for adjudication in this writ petition, which is accordingly dismissed. Pending miscellaneous petitions shall also stand dismissed. No order as to costs.
